Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Writabl platform, website, and related services (collectively, the "Service"), operated by Writabl ("Writabl," "we," "our," or "us"). By creating an account, starting a free trial, subscribing, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms form a legally binding contract between you and Writabl. Please read them carefully. Sections 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), and 17 (Dispute Resolution and Binding Arbitration) contain important limitations on your rights, including a waiver of the right to participate in a class action.
1. Definitions
- Service means the Writabl web application at getwritabl.com, writabl.io, and any related websites, subdomains, mobile or desktop applications, APIs, integrations, and features made available by Writabl.
- Account means a registered user account on the Service.
- Content means all manuscripts, chapters, scenes, notes, characters, outlines, images, research links, feedback, and any other material you create, upload, or submit through the Service.
- Subscription means a paid plan that grants access to premium features of the Service, whether billed monthly, annually, or as a one-time lifetime purchase.
- Free Trial means a temporary, no-cost period of access to the Service offered to new users.
- You or User means the individual accessing or using the Service.
2. Eligibility
The Service is available only to individuals who are at least eighteen (18) years of age. By creating an Account or using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are not prohibited from using the Service under the laws of the United States, your country of residence, or any other applicable jurisdiction.
If Writabl learns that an Account has been created by someone under 18, that Account will be terminated and any associated Content may be deleted.
3. Account Registration and Security
To use most features of the Service, you must create an Account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated.
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. You agree to notify Writabl immediately at [email protected] of any unauthorized access or suspected security breach. Writabl is not liable for any loss or damage arising from your failure to safeguard your credentials.
You may not share your Account with others, create an Account using another person's information, or maintain more than one Account without express written permission from Writabl.
4. Subscriptions, Billing, Free Trial, and Refunds
4.1 Subscription Plans
Writabl offers Subscription plans on a monthly, annual, or one-time lifetime basis. Pricing and plan details are displayed at the time of purchase and may change from time to time in accordance with Section 4.5.
4.2 Free Trial
Writabl offers a seven (7) day Free Trial to eligible new users. At the end of the Free Trial period, if you have not cancelled or subscribed, your access to premium features may be restricted or discontinued. Free Trial users are subject to the additional limitations described in Sections 11 and 12.
4.3 Automatic Renewal
IMPORTANT: PLEASE READ CAREFULLY. YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW.
By subscribing, you acknowledge and agree that your monthly or annual Subscription will automatically renew at the end of each billing cycle at the then-current rate, using the payment method on file, until you cancel. You authorize Writabl and its payment processor to charge your payment method on a recurring basis without further authorization from you.
You may cancel your Subscription at any time through your Account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing cycle. You will retain access to paid features until the end of the period you have already paid for.
This provision is intended to comply with California Business and Professions Code Section 17600 et seq.
4.4 No Refunds
All sales are final. Writabl does not offer refunds, prorated refunds, or credits for any Subscription fees already paid, including in the event of cancellation, non-use, account suspension, service changes, or termination, except where required by applicable law.
4.5 Price Changes
Writabl reserves the right to change Subscription prices at any time. For existing subscribers, Writabl will provide at least thirty (30) days advance notice of any price change by email to the address associated with your Account and by in-app notice. If you do not agree to the new price, you may cancel your Subscription before the change takes effect. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new price.
4.6 Payment Processing
Subscription payments are processed by a third-party payment processor. Writabl does not store your full payment card information on its servers. By providing payment information, you authorize the payment processor to charge the amounts owed.
5. User Content and Intellectual Property
5.1 You Retain Ownership of Your Content
You retain all right, title, and interest in and to your Content, including all copyrights. Writabl does not claim ownership of your manuscripts, chapters, characters, outlines, notes, or any other creative work you produce using the Service.
5.2 License to Writabl
By submitting Content to the Service, you grant Writabl a limited, non-exclusive, royalty-free, worldwide license to host, store, transmit, display, reproduce, and make backup copies of your Content solely for the purpose of providing and operating the Service on your behalf. This license ends when you delete your Content or terminate your Account, except as necessary for Writabl to (a) retain archived copies as described in Section 14 or (b) comply with legal obligations.
5.3 Your Representations
You represent and warrant that (a) you own or have all necessary rights to the Content you upload, (b) your Content does not infringe the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party, (c) your Content complies with all applicable laws and regulations, and (d) your Content does not violate Section 8 (Prohibited Uses).
5.4 Writabl Intellectual Property
The Service, including its software, design, interface, branding, name, logo, templates, built-in content, and all related intellectual property, is owned by Writabl or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the rights expressly granted in these Terms, Writabl reserves all rights in the Service. You may not copy, modify, reverse engineer, distribute, or create derivative works based on the Service without prior written permission.
6. Backup Responsibility
YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING INDEPENDENT BACKUP COPIES OF YOUR CONTENT.
While Writabl performs routine automated backups of its systems and offers built-in snapshot features, these backups are maintained for the purpose of operating the Service and are not guaranteed to be available for user recovery in every circumstance. Writabl does not guarantee that any specific version or piece of Content will be recoverable at any given time.
You acknowledge and agree that:
- You are responsible for regularly exporting and saving copies of your Content outside the Service, including but not limited to downloading DOCX, PDF, TXT, or EPUB exports to your local device or to a separate cloud storage provider.
- Writabl is not liable for any loss, corruption, unavailability, or deletion of Content, regardless of cause, including but not limited to software bugs, hardware failures, internet outages, data center incidents, cyberattacks, human error, service interruptions, third-party service failures, or your own actions.
- Opening the Service in multiple browsers, tabs, windows, or devices simultaneously may cause automatic saving conflicts and is not supported.
- Your failure to maintain independent backup copies is at your own risk, and Writabl bears no responsibility for any resulting loss.
This Section 6 shall survive termination of these Terms and your Account.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your Account.
8. Prohibited Uses
You agree not to, and not to permit others to:
- Use the Service in any way that violates any applicable federal, state, local, or international law or regulation.
- Upload, submit, or transmit any Content that is unlawful, infringing, defamatory, obscene, threatening, harassing, hateful, or that sexualizes minors.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorized access to the Service, other user accounts, or any systems, servers, or networks connected to the Service.
- Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures.
- Use any automated system, including robots, scrapers, or data mining tools, to access the Service or extract data.
- Interfere with, disrupt, or create an undue burden on the Service or its infrastructure, including through denial-of-service attacks or excessive requests.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
- Resell, sublicense, rent, lease, or otherwise commercialize the Service without prior written permission from Writabl.
- Use the Service to develop a competing product or service, or to benchmark against a competing product or service without Writabl's prior written consent.
- Upload any viruses, malware, or other malicious code.
- Use the Service in a manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
Writabl may investigate any suspected violation and may suspend or terminate your Account as described in Section 13.
9. Third-Party Services and Subprocessors
The Service relies on third-party service providers (sometimes called "subprocessors") for hosting, storage, email delivery, payment processing, and certain optional features. A current list of categories of third-party processors is maintained in our Privacy Policy, and a detailed subprocessor list may be requested by contacting [email protected].
9.1 Manuscript Import and AI-Assisted Chapter Detection
When you use the manuscript import feature, Writabl may send the text of your uploaded manuscript to a third-party artificial intelligence provider (currently Anthropic, PBC) for the sole purpose of automatically detecting chapter breaks to speed up the import process. Writabl has configured this feature so that:
- The manuscript text is sent only during the import process and is not retained by the AI provider after the import is complete.
- The manuscript text is not used to train, fine-tune, or otherwise improve any AI model.
- The feature is scoped exclusively to chapter detection on import and is not used to generate, rewrite, or edit your creative work.
Writabl reserves the right to expand the use of AI or machine learning to additional features in the future. Any such expansion will be disclosed in an updated version of these Terms or in the Privacy Policy before the new feature becomes available, and continued use of the Service after such disclosure constitutes your acceptance of the updated terms.
In addition, Writabl may in the future offer optional integrations that allow you to connect your own account with a third-party AI, grammar, or writing-assistance provider by supplying your own credentials or API key. If you choose to enable such an integration, the content you choose to process will be transmitted directly to the provider you selected, and your use of that provider will be governed by that provider's own terms of service and privacy policy. Writabl does not control, operate, or take responsibility for third-party providers, their models, their outputs, or their data practices. You are solely responsible for obtaining and complying with the terms of any third-party service you choose to connect.
Except as described in this Section 9.1 or in any future update, Writabl does not offer AI-generated writing, rewriting, or editing features.
10. Service Availability and Modifications
Writabl does not guarantee that the Service will be available at all times, uninterrupted, timely, secure, or error-free. The Service may be temporarily unavailable due to scheduled maintenance, emergency maintenance, updates, third-party service outages, or events beyond Writabl's reasonable control.
Writabl reserves the right, at any time and at its sole discretion, to modify, suspend, or discontinue any part of the Service, including features, functionality, templates, integrations, or plan structures, with or without notice. Writabl will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WRITABL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AVAILABILITY, AND FREEDOM FROM DEFECTS OR VIRUSES.
WITHOUT LIMITING THE FOREGOING, WRITABL DOES NOT WARRANT THAT:
- THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
- THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
- ANY CONTENT YOU UPLOAD WILL BE ACCURATELY STORED, PRESERVED, OR RECOVERABLE.
- ANY ERRORS OR DEFECTS IN THE SERVICE WILL BE CORRECTED.
- THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
YOU ACKNOWLEDGE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, the exclusions apply to the maximum extent permitted by law.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WRITABL, ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF USE, LOSS OF DATA, LOSS OF MANUSCRIPTS OR CREATIVE WORK, LOSS OF BUSINESS OPPORTUNITIES, EMOTIONAL DISTRESS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WRITABL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.1 Aggregate Liability Cap
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, WRITABL'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
YOU ACKNOWLEDGE THAT THIS LIMITATION IS A REASONABLE ALLOCATION OF RISK AND IS AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND WRITABL, AND THAT WRITABL WOULD NOT PROVIDE THE SERVICE WITHOUT THIS LIMITATION.
12.2 Free Trial Users
IF YOU ARE USING THE SERVICE UNDER A FREE TRIAL OR ANY OTHER NO-COST ACCESS, YOU EXPRESSLY WAIVE ALL CLAIMS OF ANY KIND AGAINST WRITABL, AND WRITABL SHALL HAVE NO LIABILITY TO YOU OF ANY KIND, WHETHER DIRECT, INDIRECT, OR OTHERWISE. IF APPLICABLE LAW DOES NOT PERMIT A COMPLETE WAIVER, WRITABL'S ENTIRE LIABILITY TO FREE TRIAL USERS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
12.3 Jurisdictional Limits
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any such limitation is prohibited, Writabl's liability shall be limited to the maximum extent permitted by applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Writabl and its owners, employees, contractors, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your Content, including any claim that your Content infringes the rights of a third party; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of a third party.
Writabl reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with Writabl's defense of such matter.
14. Termination and Data Retention
14.1 Termination by You
You may terminate your Account at any time by using the account deletion option in your settings or by contacting [email protected]. Termination does not entitle you to any refund of fees previously paid.
14.2 Termination by Writabl
Writabl reserves the right, in its sole discretion and without prior notice or liability, to suspend or terminate your Account and access to the Service for any reason or no reason, including but not limited to your violation of these Terms, non-payment, suspected fraud, abusive behavior, or for any reason Writabl deems appropriate. Where reasonably possible and consistent with applicable law, Writabl will offer you an opportunity to export your Content before deletion.
14.3 Data Retention After Termination
Upon termination of your Account, Writabl will retain your Content in an archived state so that you may return to the Service in the future, subject to the following:
- You may request immediate and permanent deletion of your Content at any time by contacting [email protected]. Writabl will honor such requests in accordance with applicable law, including the California Consumer Privacy Act.
- If your Account remains fully closed and inactive for a period of two (2) years or more, Writabl reserves the right to permanently delete your Content without further notice.
- Certain data may be retained beyond these periods where required by law, for legitimate business purposes (such as fraud prevention, dispute resolution, or enforcement of these Terms), or in aggregated or anonymized form that does not identify you.
15. Feedback and Suggestions
If you submit feedback, feature requests, bug reports, suggestions, ideas, or other input to Writabl ("Feedback"), whether through the Service's built-in feedback tools, by email, or through any other channel, you agree that:
- Writabl may use, reproduce, modify, adapt, publish, distribute, and otherwise exploit the Feedback for any purpose, commercial or otherwise, without compensation, attribution, or obligation to you.
- Writabl owns all right, title, and interest in any features, improvements, products, or services developed based on or incorporating the Feedback.
- You waive any and all rights you may have in the Feedback, including moral rights, to the maximum extent permitted by applicable law.
- You represent that the Feedback does not contain any confidential information of yours or any third party.
This provision does not apply to the creative Content you produce using the Service, which remains your property as described in Section 5.
16. Changes to These Terms
Writabl reserves the right to modify these Terms at any time in its sole discretion. When Writabl makes material changes, Writabl will provide notice by email to the address associated with your Account and by in-app notice, at least thirty (30) days before the changes take effect, except where immediate changes are required by law. Non-material changes may take effect immediately upon posting.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your Account.
17. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH WRITABL ON AN INDIVIDUAL BASIS AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF. IT INCLUDES A CLASS ACTION WAIVER.
17.1 Informal Dispute Resolution
Before filing any claim, you agree to first contact Writabl at [email protected] and provide a written description of the dispute and the relief you seek. Writabl and you will attempt in good faith to resolve the dispute informally within sixty (60) days.
17.2 Binding Arbitration
If the dispute cannot be resolved informally, you and Writabl agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, the Service, or your relationship with Writabl, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, shall be resolved by binding individual arbitration administered by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules and Procedures then in effect. The arbitration shall be conducted in Sonoma County, California, or by videoconference, at the claimant's election. The arbitrator's decision shall be final and binding.
This arbitration agreement is governed by the Federal Arbitration Act.
17.3 Class Action Waiver
YOU AND WRITABL AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
If this class action waiver is found unenforceable, then the entirety of this Section 17 shall be null and void, and the exclusive venue for any disputes shall be the state and federal courts located in Sonoma County, California.
17.4 Exceptions
Notwithstanding the foregoing, either party may bring an individual action in small claims court. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights pending arbitration.
17.5 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice of your decision to opt out to Writabl at the address listed in Section 20, within thirty (30) days of first accepting these Terms. Your notice must include your full name, the email address associated with your Account, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved exclusively in the state and federal courts located in Sonoma County, California.
18. Governing Law and Venue
These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Subject to Section 17, the exclusive venue for any disputes not subject to arbitration shall be the state and federal courts located in Sonoma County, California, and you consent to the personal jurisdiction of such courts.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Writabl regarding the Service and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
19.3 No Waiver
Writabl's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
19.4 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without Writabl's prior written consent. Writabl may assign these Terms at any time without notice. Any attempted assignment in violation of this provision is void.
19.5 Force Majeure
Writabl shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labor disputes, internet outages, third-party service failures, or pandemics.
19.6 Relationship of the Parties
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Writabl.
19.7 Electronic Communications
By using the Service, you consent to receive electronic communications from Writabl, including emails, in-app messages, and notices. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. You are also responsible for maintaining independent backup copies of your Content. See Section 6 of the Terms of Service for details.
7. Data Retention
We retain your information for as long as your Account is active and as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.
If you cancel your Account, we retain your Content in an archived state so that you may return to the Service in the future, subject to the following:
- You may request immediate and permanent deletion of your Content at any time by contacting [email protected]. We will honor such requests in accordance with applicable law.
- If your Account remains fully closed and inactive for two (2) years or more, we reserve the right to permanently delete your Content without further notice.
- We may retain certain data beyond these periods where required by law, for legitimate business purposes such as fraud prevention, dispute resolution, or tax and accounting obligations, or in aggregated or anonymized form that does not identify you.
See Section 14 of the Terms of Service for additional details on data retention after Account termination.
8. Artificial Intelligence and Automated Processing
Writabl does not offer AI-generated writing, rewriting, or editing features.
The Service uses a third-party artificial intelligence provider (currently Anthropic, PBC) for one limited purpose: automatically detecting chapter breaks when you import an existing manuscript, in order to speed up the import process. When you use the manuscript import feature, the text of your uploaded manuscript is sent to the AI provider solely for chapter detection. This text is not retained by the AI provider after the import is complete, and it is not used to train, fine-tune, or otherwise improve any AI model.
Writabl does not use automated decision-making that produces legal or similarly significant effects concerning you.
Writabl reserves the right to expand the use of artificial intelligence or machine learning to additional features in the future. Any such expansion will be disclosed in an updated version of this Privacy Policy or our Terms of Service before the new feature becomes available.
In the future, Writabl may offer optional integrations that allow you to connect your own account with a third-party AI, grammar, or writing-assistance provider by supplying your own credentials or API key. You are solely responsible for obtaining and complying with the terms of any third-party service you choose to connect, and Writabl does not access, store, or retain the outputs of those interactions beyond what is necessary to display them to you within the Service.
9. Your Rights
Depending on where you live, you may have certain rights regarding your personal information.
